NYSE Activates Sub-Penny Trading on 02/01/2010

On February 1, the NYSE and NYSE Amex cash markets will begin accepting, displaying and executing limit and stop orders priced less than $1 entered in sub-pennies without rounding such prices to the nearest whole penny. Pursuant to Regulation NMS Rule 612, orders priced equal to or greater than $1 entered in sub-pennies will continue to be rejected, as will limit and stop orders priced under $1 in increments smaller than $0.0001.

Partially Executed GTC orders with Cancel/Replace

On December 23, 2009, the NYSE issued guidance that GTC orders that receive a partial execution and then are cancelled and replaced are reloaded into the NYSE database on the next trading day with the original quantity of the order. The NYSE advised members and member organizations that these orders may be subject to over-execution and that, pursuant to NYSE and NYSE Amex Equities Rules 18 (“Compensation in Relation to Exchange System Failure”), they may be entitled to reimbursement for losses sustained in relation to a malfunction of the Exchanges’ systems.

Closing Offset Order Type Effective 2/22/2010

In a previous client memo dated November 16, 2009, the NYSE announced forthcoming changes to the NYSE closing process, including the introduction of a new order type; the Closing Offset (“CO”) order, pending SEC approval of amendments to Rule 123C. On December 23, 2009, the SEC approved amendments to our closing auction rule. The Exchange is excited to introduce these changes, along with the CO order type beginning on Monday, February 22, 2010.

Matching Engine Problem Resolution Procedures: NYSE and NYSE Amex Cash Markets

These automated procedures are initiated when the link between the gateway process and the NY matching engine is interrupted. NYSE Amex Announces Change in Equities Transaction Pricing Effective Monday, January 4th

On October 1, 2009, Amex equities increased the liquidity-providing rebate for all customers to $0.0030 per share from $0.0015 in securities priced above $1, including displayed and non-displayed orders. The take rate for removing liquidity remained $0.0025. As described, this inverted pricing plan would be in effect for a minimum of three months.
