Liquidity Replenishment Point (LRP) Price Parameters Widened

30 Sep 2008

Beginning on October 1, 2008, the Exchange is doubling the LRP ranges. By widening the current values, the Exchange is limiting the amount of time automatic execution is suspended, while continuing to provide protection from volatile order flow. This will allow for more continuous automatic executions of securities but continue to integrate the auction market to provide the opportunity for additional liquidity.

Reminder of Final Deadline for New CMS Session Requests

In a previous client communication on August 5, 2008 the Exchange reported that we will be decommissioning CMS on December 31, 2008. As part of that communication, we mandated a cutoff date of October 3, 2008 for all new CMS session requests. As a reminder this Friday, October 3, 2008 will be the last day the Exchange will accept new CMS sessions requests.

CCG connectivity is now responsible for 75% of the orders entered in to Exchange systems on a daily basis. With this milestone reached, we have reduced capacity in CMS by one-third, with plans to reduce the capacity further as the CCG connected order flow percentage increases.

Washington Mutual Update

Washington Mutual Inc., (WM), Washington Mutual Preferred K (WM PRK) & Washington Mutual Preferred R (WM PRR) have been subject to a Regulatory Halt since last last Friday, 26, September 08. The company will be delisted from the NYSE today and will be available to trade in the Pink Sheets.

Orders entered in these securities may be canceled today. Any orders not canceled today will be deleted overnight and these symbols will no longer be available as of tomorrow, Tuesday, 30, September 08.

Consolidated Exchange Covered Short Sell List

On Friday, September 19, 2008, the SEC Released an Emergency Order prohibiting short sales in 799 securities (http://www.sec.gov/rules/other/2008/34-58592.pdf). On the following Monday the order was amended with important material differences:http://www.sec.gov/news/press/2008/2008-218.htm that included the SEC's delegation of authority to each national securities exchange to identify and add listed companies that qualify for inclusion on the covered list.

Washington Mutual Update

26 Sep 2008

Important update regarding NYSE trading in Washington Mutual Inc. (WM) and Washington Mutual Preferred K (WM PRK) today, Friday, 26 September 08.
Consistent with Reg NMS, NYSE will open WM and WM PRK for a single transaction, then immediately place it in an Operational Trading Halt under the NYSE Sub-penny Pricing rule.
Firms should cancel any orders in WM and WM PRK that are not executed in the Opening transaction. After the close of business today, NYSE will cancel any unexecuted orders in WM and WM PRK.

NYSE/AMEX Integration Update

As previously announced in the September 9, 2008 Information Memo titled ‘NYSE/Amex Integration – Trading Systems Update', member firms were informed that Amex Equities will be migrated onto the NYSE Trading Platform in the December 1, 2008 time frame. In preparation for this integration, the NYSE will support Member Firm testing on four Saturdays throughout October and November for firms to ensure their readiness. It is recommended that all Member Firms participate in the planned testing.

Revised SEC Short Sell Order

Please be advised that today the SEC has revised its temporary emergency action with respect to the Order prohibiting short selling in financial firms. As there will likely be material differences in the application of the prohibition, you should read the new SEC order. The SEC has informed us that all companies that were covered by Friday's order will also be covered by the revised short sale prohibition. The SEC has also advised us that it expects to delegate to each national securities exchange the authority to identify additional listed companies that qualify for inclusion in the list of companies covered by the revised prohibition.

SEC Ban on Short Sales

19 Sep 2008

Effective immediately the SEC Emergency Order prohibits short sales for 799 securities noted in Appendix A of the linked SEC Order. Please note that the SEC exempted the following from the prohibition: “registered market makers, block positioners, or other market makers obligated to quote in the over-the-counter market, in each case that are selling short a publicly traded security of an Included Financial Firm as part of bona fide market making in such security.” Please refer to the Order for a full list of exemptions.

Please also note that NYSE systems will not block sell short orders. The SEC Order requires that firms be responsible for compliance with this Order.

Lehman Update

Barclays & Lehman 09/17/08

The NYSE has lifted the news dissemination halt on Lehman Brothers allowing other markets, including NYSE Arca, to trade the security. Lehman will not open or trade on the NYSE.


The decision to lift the news dissemination halt was based on Lehman’s press release issued last night outlining Barclays agreement to acquire Lehman Brothers' North American investment banking and capital markets operations.


As previously reported, Standard & Poor’s has removed Lehman from their indices. For additional detail on the removal of Lehman from the S&P please go to the S&P website.

Opening Trades Update

15 Sep 2008

As previously reported, the Consolidated Trade System (CT) experienced problems this morning between the opening and approximately 9:38am. The system did not publish sales in Tape A securities (NYSE-listed) from any exchange in the security symbol range 'A' through 'L'. The New York Stock Exchange has provided to the Consolidated Tape System all of its opening prints in the affected symbols, and the Consolidated Tape System has added these prints to the tape with an 'N' exchange modifier, and an 'OPD' trade modifier (indicating an out-of-sequence, opening trade).

Please note that different vendors will process trades marked with 'OPD' differently for VWAP calculations. For example, Bloomberg may include these trades in its VWAP calculation while Thomson Reuters will not. If you have any questions regarding various VWAP calculations or other treatment of 'OPD' trades, please contact your market data vendor.

Opening Trades Update

The Consolidated Trade System (CT) experienced problems this morning at the opening. The system did not publish opening sales to the consolidated tape for securities A through L in Tape A.

Please note that the NYSE opened these securities and issued trade reports throughout this period at the correct trade prices, and that they continue to trade.

CT will be modified today to include the NYSE opening trades. Those trades will be printed to the tape with an .OPD indicator to note them as the opening trade.

Consistent with the guidelines under the NYSE Sub-penny Trading Rule, Lehman Brothers Inc. (LEH) will not trade on the NYSE today. Trading will take place in Arca today. NYSE orders in the common will begin routing to NYSE Arca with NYSE Arca pricing applied Tuesday 9/16/08. Please be advised that LEH continues to be listed on the New York Stock Exchange. Please also be advised that LEH preferreds continue to be listed and traded on the New York Stock Exchange.

In order to allow customers to cancel existing orders in the NYSE's system, LEH will remain active until close of business today at which time the NYSE will cancel any remaining orders in this symbol. Starting tomorrow all orders in this symbol will be routed to NYSE Arca with NYSE Arca pricing applied.

Update on Lehman Brothers Trading and Specialist Unit

The New York Stock Exchange (NYSE) has announced the following in connection with today's market news and conditions with respect to Lehman Brothers. Lehman Brothers Holdings Inc. (“LBHI”) announced today that it intends to file a petition under Chapter 11 of the U.S. Bankruptcy Code with the United States Bankruptcy Court for the Southern District of New York. None of the broker-dealer subsidiaries or other subsidiaries of LBHI will be included in the Chapter 11 filing and all of the broker-dealers will continue to operate.
Lehman Brothers continues to be a member firm and a listed company of the New York Stock Exchange until further notice.


Trading of Lehman Brothers Stock
The stock of Lehman Brothers Holdings (LEH) is being traded today on NYSE Arca as of 4:00 a.m.


Lehman Specialist Unit
Effective immediately, Goldman Sachs will be assuming responsibility for NYSE-listed securities in which Lehman Brothers MarketMakers, a division of Lehman Brothers, has served as the specialist. Lehman specialist staff and technology will remain in place, and Goldman Sachs will oversee staff, trading and risk management.
Goldman Sachs will also be responsible for clearing activity of the Lehman specialist unit in these securities going forward.
This arrangement will remain in place until a more permanent alternative can be arranged. We will keep you apprised of further developments as we work to ensure a smooth transition as well as fair and orderly markets in all NYSE-listed securities.

NYSE/Amex Integration (NYSE Alternext U.S.): Revised Notice - NYSE system changes

09 Sep 2008

As previously announced in the August 15, 2008 NYSE Trader Update, NYSE Euronext is moving the timing of the American Stock Exchange equities integration to early December from mid-September. The extension responds to member firms' requests for additional time to make and test necessary programming changes, as well as for trading and post-trade system modifications that will make the transition easier for the firms. Amex-listed structured products and ETFs that will be transferring their listing to NYSE Arca will move in a phased approach beginning shortly after the closing of the transaction and continuing through the end of November. Upon completion, all Amex equities will then be migrated over to the NYSE trading platform. Additionally, changes are being implemented to pass the executing exchange back to the firms in CCG FIX Tags 207 (SecurityExchange) and 30 (LastMkt) as well as on new fields/values of NYSE Post Trade and Intra-day Contract outputs.
