Enhanced NYSE Business Continuity Plan retires Contingency Trading Floor

29 May 2008

In an effort to provide firms with updated and expanded business recovery capabilities, NYSE Euronext will retire our Contingency Trading Floor and instead will request, that in the event of a BCP scenario, firms redirect their order flow to the NYSE Arca trading platform. All firms that are currently connected directly to NYSE Arca or have access through a current NYSE Arca ETP (Electronic Trading Permit) holder will continue to have access to the NYSE Arca platform.

In addition, registration as an NYSE Arca ETP holder will not be necessary for this limited purpose. The NYSE is proposing that during an event in which NYSE trading is moved to the NYSE Arca platform, NYSE Arca rules and fees governing trading shall apply, however, all trades will be reported to the Consolidated Tape as NYSE trades. This contingency would be effective on a next day basis. These contingency arrangements are subject to filing and SEC approval.
